If anyone takes a photograph of a person or make a video and display or distribute it without his consent in a manner that harms a person falls within the definition of cyber stalking. Punishment is 3 years and fine may extend to one million rupees. Read section 24 of PECA 2016. Keep in mind making of any video is not a crime, distribution and displaying without consent shall be considered as crime. It is similar to section 21 of PECA where public exhibition or displaying or transmission of sexually explicit images or videos shall be considered as offence. Mere making or capturing will not be a offence unless or untill it has been distributed or displayed online or through any social media forum.
